Former Director of the Ghana School of Law, Kwaku Ansa-Asare, has revealed that the attack by Chief Justice Gertrude Torkornoo of the constitution means her appointment was a complete violation of the law.

During an appearance on TV3’s Key Points, he stated that the constitution stipulates the appointment of a Chief Justice can only be done by the president through consultation with the Council of State as stated in article 144(1). According to Ansa-Asare, if the Chief Justice deems her removal process, initiated by Article 146 of the constitution, unconstitutional, then her appointment is likewise unconstitutional.

He further admitted that former President Akufo-Addo did not choose the ideal method or approach when he chose Justice Torkornoo above other senior colleagues.

“I have always advocated that seniority must be respected. Akufo-Addo did not do the right by appointing only those he can work with to the highest positions. I said it was going to bring pocket Justices who would be manipulated to do the bidding of the government in power”.

“We have an ailing Judiciary that needs serious operation”, he said.
