Suspended Chief Justice Gertrude Torkornoo has filed a lawsuit at the Supreme Court to stop the five-member committee probing her removal.

She is seeking an injunction to block proceedings of the committee charged to bring finality to the petitions against her.

She also wants Justices Gabriel Scott Pwamang and Samuel Kwame Adibu-Asiedu to be taken off from being part of the proceedings of the committee looking into the petitions against her.

According to the application filed on her behalf by former Attorney General, Godfred Yeboah Dame, the two justices met with a lawyer privately regarding her petition case which is being investigated by a committee established by President John Dramamni Mahama.

She is further pleading with the court to restrain the committee from taking any action in connection with the petitions brought against her.

The committee is made up of Justice Gabriel Scott Pwamang and Samuel Kwame Adibu-Asiedu both at the Supreme Court, former Auditor-General Daniel Yaw Domelevo, Major Flora Bazwaanura Dalugo and Professor James Sefah Dzisah.

President John Dramamni Mahama suspended the Chief Justice in line with article 146(6) of the Constitution, after a prima facie case was established against her. The President took the decision after consulting the Council of State.

Also, the president sought the consent of the Council of State to set-up a 5-member committee to investigate the petitions.

Reasons Why Chief Justice Getrude Torkonoo Petitioned The Supreme Court

Alfred Ababio Kumi petitioned the president to stop the 5-five-member committee probing the petitions against the suspended Chief Justice.

Kumi alleged that Mr. Thaddeus Sory who is a counsel for one of the petitioners met with two committee members in the person of Justice Gabriel Pwamang and Samuel Kwame Adibu-Asiedu, and a non-member Justice Yonny Kulendi at Santoku Restaurant in Accra’s Airport Residential Area after the first sitting in the matter.

He believes such meetings can distort the fair judgement the committee suppose to give and as matter of urgency, the president should dissolve the committee.
